NOTICE IS HEREBY GIVEN THAT the Winthrop Town Council will hold an open record public hearing to consider a proposed amendment to the Conditional Use Permit for Fresh Greens on Wednesday, September 16, 2015 at 7:05 pm, Winthrop Auditorium (the Barn) 51 Highway 20, Winthrop, WA. The hearing will be conducted in accord with WMC Chapter 19.10. Any person desiring to present written or oral testimony may do so at the hearing. All persons or agencies who comment or present testimony shall have standing as a party of record. Any person requiring assistance to access the Barn or requiring other special assistance are urged to contact Town Hall as least 24 hours in advance of the scheduled hearing.
Application Information: Austen Lott, 5 Lloyd Lane, Winthrop, WA 98862, applied to amend the conditional use permit (CUP) for Fresh Greens, a marijuana retail business encompassing 540 square feet. The proposed amendment would expand the hours of operation allowed under the CUP and allow the business to open on Sundays. The permit is sought pursuant to Winthrop Municipal Code (WMC) sections 17.16.010 and 17.36.045. The business is located on Lot 29 of Horizon Flats subdivision, in the Industrial zone of the Town of Winthrop, Township 34, Range 21, NW quarter of Section 11. Application materials are on file at Winthrop Town Hall, 206 Riverside Ave. Persons wishing to view project information or receive notice of the action taken on the application may contact Winthrop Town Hall between the hours of 9 a.m. and 4 p.m., Monday – Friday. The project lies within the 100 year floodplain, shoreline and critical area.

Failure to pay interest (per diem of $2.53 per day) from April 25, 2015 through July 6, 2015 of $184.69.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 9th day of October, 2015. The defaults referred to in paragraph III must be cured by the 28th day of September, 2015, (11 days before the sale date), to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before the 28th day of September, 2015, (11 days before the sale date), the defaults as set forth in paragraph III are cured and the Trustee’s fees and costs are paid. The purchaser at the trustee’s sale is entitled to possession of the property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not tenants. After the 20th day following the sale, the purchaser has the right to evict occupants who are not tenants by summary proceedings under the Unlawful Detainer Act Chapter 59.12 RCW.
