NOTICE OF PETITION FOR EXCLUSION

NOTICE IS HEREBY GIVEN that a petition for exclusion of land has been filed with the Board of Directors of the Methow Valley Irrigation District (MVID).  The name of the petitioner and the land description, identified by the Okanogan County Assessor’s parcel number, to be excluded from the boundaries of the MVID without a water right, in Okanogan County, State of Washington, are as follows:

Parcel, Acres, Owners: 5101140002, 2.20, PUD #1 of Chelan County

All persons interested in or who may be affected by the change of the boundaries of the District are to appear at the Regular Meeting of the MVID on the 13th day of June, 2016 at 7:00 p.m. at the River Bank Office, 206 Glover Street, in Twisp, WA to show cause in writing, if any they have, why the change of the boundaries of the District, as proposed in the petition, should not be made.  The failure of any person interested in said District to show cause in writing why the tract of land mentioned in said petition should not be excluded from the MVID shall be deemed and taken as an assent to such exclusion. BEFORE THE WASHINGTON STATE DEPARTMENT OF ECOLOGY YAKIMA, WASHINGTON

NOTICE OF APPLICATION TO CHANGE PLACE AND PURPOSE OF USE AS AUTHOROZED UNDER CLAIM NO. 129470 AND CLAIM NO. 129471

AND NOTICE OF APPLICATION FOR A NEW MITIGATED APPROPRIATION OF PUBLIC WATERS UNDER APPLICATION NO. S4-33166

TAKE NOTICE: That on October 26, 2015, Barkley Irrigation Company (BIC) of University Place, Washington applied to change the place of use and purpose of use under Claim No. 129470, and Claim No. 129471 by submitting change application number is CS4-129470CL@4.  Both claims represent a single pre-code vested water right.

Claim No. 129470, under priority date of June, 1900 claims the diversion of 85 cfs and 61,200 acre-feet per year from the Methow River with the point of diversion located within Sec. 13, T. 34 N, R. 21 E.W.M. for the irrigation of 900 acres during the irrigation season.

Claim No. 129471, under priority date of September, 1909 claims the diversion of 60 cfs and 43,200 acre-feet per year from the Methow River with the point of diversion located within Sec. 13, T. 34 N, R. 21 E.W.M. for the irrigation of 900 acres during the irrigation season.  However, ecology noted an error in the claimed location based on a GPS measurement associated with a subsequent change authorization, locating the actual diversion within SE¼ SW¼ SW¼ S. 12, T. 34 N., R. 21 E.W.M.

The 900 acres authorized for irrigation under Claim Nos. 129470 and 129471 are located in Sections 13, 24, and 25 of T. 34 N., R. 21 E.W.M., Sections 19, 30, and 31 of T. 34 N., R. 22 E.W.M., and Sections 5, 6, and 8 of T. 33 N., R. 22 E.W.M.

Change Application No. CS4-129470CL@4 proposes to change the purpose and place of use of BIC’s water right to instream flow and mitigation.  The transfer to instream flow is intended to benefit the Methow River from the historic point of diversion to the confluence with the Columbia River.  This transfer is also intended to provide mitigation through the creation of a water bank to mitigate out-of-stream uses, including irrigation and to facilitate irrigation efficiency improvements associated with the BIC.

On October 26, 2015, Barkley Irrigation Company (BIC) of University Place, Washington under Application No. S4-33166, applied to appropriate surface water, subject to existing rights, mitigated by the two above mentioned BIC water rights transferred to Ecology’s trust water program.  Application No. S4-33166 requests 26.0 cubic feet per second and 8,327.57 acre-feet per year from the Methow River, from a diversion point located within Sec. 24, T. 34 N, R. 21 E.W.M., for the seasonal irrigation of 640 acres in sections 13, 24, and 25 of T. 34N., R 21 E.W.M., sections 19, 30, and 31 of T. 34N., R 22 E.W.M., and sections 5, 6, and 8 of T. 33N., R 22 E.W.M.

Protests or objections to the approval of these applications must include a detailed statement of the basis for objections.  All letters of protest will become public record.  Cash shall not be accepted.  Fees must be paid by check or money order and are nonrefundable.   Protests must be accompanied by a fifty dollar ($50) recording fee payable to the Department of Ecology, and filed with the Department of Ecology Cashiering Unit, P.O. Box 47611, Olympia, WA 98504-7611 within thirty (30) days from June 8, 2016.

LEGAL NOTICE

Methow Valley School District No. 350 will hold a public hearing on the budget for the 2016-2017 General Fund, Transportation Vehicle Fund, Capital Projects Fund, Debt Service Fund and ASB Fund at the Board of Directors meeting in the district office at 5:30 p.m. on Wednesday, June 22, 2016. Any person may appear and be heard for or against any part of said budget.  A copy of the budget is available for review at the superintendent’s office. Tom Venable, Superintendent of Schools.

NOTICE OF ADOPTION OF ORDINANCE NO. 681 TOWN OF WINTHROP, WASHINGTON) NOTICE IS HEREBY GIVEN that the Town of Winthrop has adopted its Ordinance No. 681, which in summary, adopts restrictions on the possession, use or sale of fireworks; adopts times when discharge of consumer fireworks are permitted; adopts permit application requirements for public display of fireworks; and provides for exceptions and penalties. Said ordinance may be examined at the Winthrop Town Hall during regular business hours or a copy will be mailed upon request. This notice is given by order of the Town Council and pursuant to R.C.W. 35.27.300.

NOTICE OF ADOPTION OF ORDINANCE NO. 682 (TOWN OF WINTHROP, WASHINGTON) NOTICE IS HEREBY GIVEN that the Town of Winthrop has adopted its Ordinance No. 682, which in summary, amends section 13.16.290, Late Charge, and repeals section 13.16.300, Delinquent Account, of the Winthrop Municipal Code. Said ordinance may be examined at the Winthrop Town Hall during regular business hours or a copy will be mailed upon request. LEGAL NOTICE

Notice of Open Record Public Hearing. NOTICE IS HEREBY GIVEN that the Town of Twisp Board of Adjustment will hold an open record public hearing at 5:00 p.m. on Thursday, June 23, 2016 at Twisp Town Hall.   The purpose of the hearing is to take testimony and establish the record on the application for a variance from the 19,200 square foot lot size requirement for the addition of an accessory dwelling unit in the R-1 Zoning District.

All interested persons are invited to attend and be heard.  Those requiring assistance are requested to contact Town Hall a minimum of 24 hours prior to the scheduled hearing to notify the Town of the type of assistance required.  Persons wishing to view project information may contact Twisp Town Hall, 118 S.
